WASHINGTON (Reuters) – The U.S. Supreme Court overruled President Barack Obama’s high court nominee Sonia Sotomayor on Monday in an important race discrimination case, but the White House remained confident she would be approved.
This is the most controversial of the past cases that Sotomayor participated in. One Hispanic and 19 white firefighters claimed they were discriminated against by the city of New Haven when their promotion tests were thrown out because no African-Americans scored well enough to qualify. Subsequently, the firefighers sued the city, lost their case, and then lost their appeal to the court where Judge Sonia Sotomayor sat. She ended up ruling against the firefighters, claiming that the city was within its rights.
Opponents are concerned that Sotomayor shows that she has radical activist views when it comes to race and gender. This case seems to support that view.
